Message from the Board


Welcome to October!

September was a very intense month for the Board as the Vote was counted for the CC&Rs and Bylaws Restatements and the work continued – so missed getting a newsletter out during the month.

The results of the Vote were a mixed lot.  The Bylaws passed (as the threshold for passage was 51% of the votes) but the CC&Rs just missed.  The threshold for passage is a high bar – 75% of all eligible votes.  This means that anyone who did not send back a ballot effectively was a negative vote. Of the votes received, though, a good majority voted in favor of the Restated CC&Rs.

These results left the Board with a decision to make.  It’s impractical and inconceivable to revert to the current CC&Rs so the choices left with were:

  1. Take the results of the vote and proof of the HOA effort to a San Mateo County judge to plead the case that all due diligence was made, but the bar was too high.  This option would have carried an additional burden of large legal fees, court fees, uncertain timetable and outcome. Plus, the Board had heard your concerns about the CC&Rs as presented.
  2. Listen to the Owners concerns, edit & clarify items in the Restated CC&Rs and put it back to a Vote.

At the original Town Hall and during the recent mini–Town Halls by Building, the Board collected good feedback and was able to address specific concerns brought to the table. Having completed this project over last weekend, the Board has now sent the changes and clarifications to legal for an update to the Restated CC&Rs.  It is our intent to have this document ready to be sent to ProElections for mailing with a new Ballot by mid-October.  This could mean a new Vote date as early as mid-November.

The Board cannot stress enough to every Owner in Residence and every Owner of Rental Units how urgently it is that they return their ballots – regardless of their position.  We are double checking that the addresses on file for absentee owners are accurate and will reach out to anyone who would like help with or who has additional questions about their ballot when they are received.

It is the time of the year for Budget analysis and proposal.  You will be receiving information regarding the financial impacts of the CC&R votes (with charts and graphs) and other budget information in an e-blast from the Board soon. Again, the Board will be available for any questions regarding this information.

Many thanks to those who have volunteered lately.  We now have a new Design and Standards Committee (yogadawn@yahoo.com for info) and folks willing to help with updating our website and assisting with the newsletter.  
We are also currently looking for anyone with IT skills to assess a communications/WIFI upgrade to the Clubhouse for future meetings and social events. If you are interested, please contact: cclarkco019@gmail.com

Did You Know

Per Recology of the Coast:

COMPOST
Food scraps, soiled paper, and plants go in the green compost cart. 

Do not put any containers with compost into the green bin. (Like a big plastic container with old salad greens, etc.) Recology will just chuck it all into the landfill trash.

RECYCLE
Paper, bottles, cans, and most plastics plastic (no bags!)
